The reason for this annulment was that Diego had a wife in Tenerife in the Canaries before he came to Santa Fe sometime before 1622. Fray Alonso Benavides came to Santa Fe sometime in 1626 as head of the church in Nuevo Mexico and as a representative of the Inquisition. As a layman, Benavides had been the Sheriff of the Inquisition in the Canaries. The presence of Benavides compelled Diego to disclose his bigamous status. Records place him in Santa Fe on July 19, 1619 and could be interpreted as indicating he confessed that year. This seems unlikely since DIEGO did not marry Maria de Abendaño until 1622 and Fray Benavides did not arrive in Santa Fe until 1625 or 1626.
After he confessed DIEGO was taken to Ciudad de Mexico where he was tried by the Holy Office. Benavides pleaded that DIEGO had confessed the crime voluntarily and that he was a good encomiendero who personally taught the catechism to the Indians under him. Sentence was announced in Ciudad de Mexico on Mar 23 1630 that he was to return to his wife in the Canaries and never come back to Nuevo Mexico. He sailed for the Canaries in the company of the Fray Benavides. It is not known if he reached the Canaries and if he did, whether Catalina took him back.
Two daughters had been born to Maria and DIEGO, Maria Ortiz de Vera (or Baca) and Petronia who used the name Salas. After Maria de Abendaño's marriage to DIEGO de VERA was declared invalid, Maria married Antonio de Salas, step-son of Pedro Lucero de Godoy. Antonio was accused in 1664 of having relations with Petronia. Petronia was killed at Pojoaque in 1680 with all her children, eight or ten in number.

Simon was previously reported to have been the son, apparently illegitimate, of Juan Lopez Holguin and a woman known only by her last name, Abendaño. Simon was a 1/2 brother of Isabel and Ana Holguin and to Cristobal Lopez Holguin. (See Beyond ONMF volume 2, page 13 for a discussion of the likelyhood that Simon was not the son of Juan Lopez Holguin.)
