He for over 33 hours stood off 80 Texan cowboys in Frisco (San Francisco now Reserve ) in October of 1884 after he, as a self appointed sheriff, arrested a cowboy named McCarty and took him to the Middle Plaza to hold him. McCarty had been shooting up the town and harassing the citizens. McCarty's boss, ranch foreman Perham, demanded the release of McCarty and Baca did not agree and shot several of the ranch hands. Next morning the Justice of the Peace fined McCarty $5.00 and released him. As Baca left the scene the ranch owner Tom Slaughter and the 80 cowboys confronted Baca. Baca took refuge in a shed and endured over 4,000 shots from the cowboys. After 33 hours he gave up and was taken to Socorro for trial. He was tried twice but was acquitted.
