[3226] This land was too close to the Taos Pueblo, against specific regulations concerning Spanish ownership of land near pueblos. Sebastion brought suit against Governor Bustamante for his loss of crops and stock. He lost the suit and had to pay a fine for perjury and misrepresentation.

[3223] Kessell, Hendricks and Dodge report he was born in San Luis de Potosi, but it seems more likely he was born in Santa Cruz de la Cañada.
[3234] He was living in the pueblo of Guadalupe del Paso when inspected by de Vargas prior to the entrada. In his household was his wife and one son. His widowed mother, three brothers and two sisters were living in el pueblo de Socorro, somewhat less than 5 leguas (13 miles) south of Guadalupe del Paso. His mother was identified as the fourth household in Guadalupe del Paso..

The area of his hacienda was know as Rio Arriba or La Soledad. La Soledad was recorded by Dominguez in 1777 as being a legua (2.6 miles) north of San Juan Pueblo. This distance would place it exactly at Alcalde, even though many have reported the location to be at La Villita, 0.95 miles further to the north. He built a chapel there that was mentioned in the 1777 survey of churches in Nuevo Mexico by Fray Francisco Atanasio Dominguez. Dominguez says that it was a small chapel and notes that its patron was Sebastián Martin and that in 1777 his substitute and heir was a son of his called Marcial Martin. The chapel was was called la Nuestra Señora de la Soledad and was described as follows:
"This little chapel is adobe and resembles a small bodega. It faces west and is 14 to 16 varas long, 5 wide, and 6 high. There is no choir loft. There is a poor window on the Epistle side facing south, and the door is squared with one leaf and a key. The roof is of wrought beams; there is a small belfry with its brass mortar (bell), and a little cemetery. The altar screen is nothing more than a middle-sized niche like a cupboard in the wall and in this there is a middle-sized image in the round whose title is Our Lady of Solitude, although her dress is a mother-of-pearl tunic and a blue mantle, all of smooth ribbed silk, silver radiance, and linen apron. On the whole wall were the high altar is there are some large paintings of saints on buffalo skin in the local style. The alltar table is adobe, with its altar stone, cross, candle-sticks, and a little bell. It has old vestments of flowered cloth with all accessories, includeding linen. Chalice, paten, and spoon, all of silver, and glass cruets on a Puebla plate, and an old missal.
The only functions here are two novenas and a mass annually. The alms for this are collected from all the settlers in the mission's jurisdiction. The citizens of this Rio Arriba are of different classes: some are masters, others servants, and still others are their own masters and servants. They all speak the local Spanish." At some times the chapel was known as El Puerto de Nuestra Senora de la Soledad de Rio Ariba. It is mentioned in several Baptism and matrimonial records of San Juan de los Caballeros.
Sebastián built a house with 4 rooms and 2 strong towers "for defense against the enemy in case of an invasion." This land was originally granted to Jose Garcia Hurtado, Sebastián Vargas and Sebastián de Polonia but they did not develop the holding. Sebastián and Antonio Martin Serrano petitioned for the land in 1703 with the claim that Sebastián and five of his brothers had lived on the land and possessed it for some time. Sebastián renewed his request in 1711 to the Admiral Don Joseph Chacón, Marques de la Penuela, Governor and Capitan-general of the kingdom of Nuevo Mexico, in his name alone because he was the only one to continue to occupy and use the land. The grant is identified on modern maps as the Sebastián Martin Grant. Even though the original grant was larger, description of the tact on modern maps is as follows: The western boundary of the grant is a mile or so west of the Rio del Norte (Rio Grande) and runs roughly parallel to the Rio in a northeasterly direction for about 8 miles from the north boundary of the San Juan Pueblo grant to a point near La Joya (presently known as Velarde). The north boundary runs straight east from Velarde for about 12 miles to a point near Chamisal. The eastern boundary runs south for about 5 miles down through Las Trampas and Ojo Sarco. The southern boundary then runs back west, in line with the north boundary of the San Juan grant to close with the west boundary. The original northern boundary was several miles further north to about Embudo and ran east to the pueblo of Picuris. This would have made the total size about 60,000 acres. The official size of the grant patented by Congress in 1893 was 51,387.20 acres.
Sebastián gave the pueblo of San Juan a portion of the grant near the Rio in return for their help in building an acequia madre on the east side of the Rio. In June of 1751 he also gave a tract to the people of residing las Trampas at the far eastern edge of the tract. On July 15, 1751, Juan Argüello and the heads of 11 other families were awarded the Las Trampas grant by Governor Cachupin to formalize and supplement the land given by Sebastián. The name was given because of the beaver traps (trampas) set along the stream which heads on the north side of Truchas peak and runs to the west. The Town of Las Trampas grant was patented by Congress in 1903 as 28,131.67 acres.
Santiago Lucero, the husband of Sebastián's granddaughter, Bárbara Padilla, was granted power of attorney in 1772 to settle and partition the estate of Sebastián Martin Serrano. (Spanish Archive #692) (Santiago and Bárbara were the great-grand parents of Maria Vitalia Salazar.) The power of attorney was granted by Juana Padilla, daughter of Julian Padilla, son of Juan Antonio Padilla and Margarita Martin Serrano. Margarita was Sebastián's daughter. Why Juana, Sebastiáns' great-granddaughter, had authority to appoint an administrator is an interesting question.
In addition to this grant, Sebastián Martin Serrano controlled a large tract of land in the Taos area from about 1723 till 1763. In 1795 and 1800 his heirs were selling this land. Whether they actually had legal rights to this land is questionable. The land had belonged to his father-in-law, Don Fernando Durán y Cháves.
