Killed in Estancia Springs in a confrontation.
By 1883 the Otero claim to the huge Bartolome Baca Spanish land grant in the Estancia Valley had been inherited by 23 year old Manuel B. Otero of La Constancia, a village a few miles south of Tome.
Manuel B. Otero, only son of Manuel A. Otero, had inherited the family interest in the Spanish grant upon the death of his father in l88l.
Manuel B., who was born in Peralta in l860, was a highly educated and cultured young man who spoke four languages fluently, Spanish, English, French and German. He had attended Georgetown University, and before graduating had been sent to Germany to continue his education for two years under the supervision of Jacob Spielberg, who had founded the Spiel- berg mercantile firm in New Mexico years before.
Returning to Valencia County, Otero was married to the young and beautiful Eloisa Luna, member of the pioneer, promienent and wealthy Luna family of Los Lunas, New Mexico.
In l883, Manuel B. Otero was running about 35,000 head of sheep in the Estancia Valley. Otero lived at his home in La Constancia with his wife and two children, leaving his Estancia Valley ranch headquarters of La Estancia, at Estancia Springs where the town of Estancia is located today, in charge of his ranch foreman, Jesus M. Chavez.
La Estancia was located within the boundaries of the so-called Estancia Land Grant a Mexican land grant which had been carved out of the center of the older Baca Spanish land grant and which had been purchased by Joel P. Whitney, the Boston millionaire.
The conflicting claims of the Otero and Whitney interests in a large share of the Estancia Valley were in the process of court litigation in l883 when James Whitney, younger brother of the Boston capitalist, obtained writs of ejectment against all "squatters" on the Estancia Land Grant.
After evicting McAfee from his ranch at Antelope Springs and paying him nearly $ll,000 for his cattle and ranch improvement, Whitney and a few companions rode six miles South to La Estancia to deal with Manuel B. Otero.
James G. Whitney arrived at La Estancia on Thursday evening, August l6, l883.
Whitney's companions included his wife's brother, Alexander Fernandez; Arthur Bailhache, a young man who lived in Santa Fe, and several cowboys. Finding Chavez alone at La Estancia, the Whitneys party spent the night in the cabin there, awaiting the arrival of Manuel B. Otero who was expected in the morning.
Otero, after a 60 mile ride from La Constancia to La Estancia by way of Hell Canyon, reached his ranch headquarters shortly after 9a.m. on Friday, August l7. His small party included Dr. Edward C. Henriques of Las Vegas and Carlos Armijo of Las Cruces, said by the early newspapers to have been his brother-in- law.
The meeting between the Otero and Whitney parties outside the ranch headquarters appeared to be a friendly one, according to witnesses, and there was handshaking around.
After some discussion in the yard, both parties entered the cabin and continued their talks in a small room, which was furnished only with three single beds and a double bed. Several of Whitney's men were sitting on the beds, playing cards.
The conversation in the room between Whitney and Otero grew a little heated after about 20 minutes, according to witnesses, Whitney insisting that Otero vacate the ranch property, and Otero asking to see a writ of ejectment against him.
Whitney said he did not have the writ with him, and Otero asked him by what authority he was evicting him.
According to some witnesses, Whitney drew his gun and answered, "By this authority," although Whitney later claimed that he did not draw his weapon until he noticed that one of Otero's companions, Dr. Henriques, had drawn his gun and had him (Whitney) covered.
Witnesses would never say who fired the first shot but agreed that more than a dozen shots were exchanged in the small room within the next few seconds.
Before the smoke had cleared, the unharmed, Alexander Fernandez, Whitney's brother-in-law, was lying dead on the floor next to the bed on which he had been seated.
Manuel B. Otero, wounded in the neck, staggered out of the door and collapsed.
James G. Whitney, shot four times in the body, jaw and hand, lay critically wounded on the floor of the cabin.
Dr. Henriques, who had bee shot in the arm, was pointing a gun at Arthur Bailhache and shouting: "Give up now--give up possession." "For God's sake don't shoot me--I've nothing to give up," Bailhache screamed.
Dr. Henriques made Bailhache get down on the floor next to the wounded Whitney, then sat down on a bed and dropped his gun when Whitney ordered his men to give up possession of the house.
When order had been restored and tempers were calmed, Bailhache hurried West to Chilili, hired a wagon, rode quickly to Albuquerque and spread news of the tragedy. An Albuquerque physician, Dr. W.B. Lyon, rode quickly to La Estancia to treat the wounded.
Otero and Whitney, both critically wounded in the gunfire, each signed a statement saying he did not know who had shot him. Otero lingered about five hours after the shooting spree, and died.
News of the tragedy at Estancia Springs spread like wildfire and shocked the entire territory.
While recuperating from gunshot wounds in Santa Fe, James Whitney was charged with Otero's murder. Joel and his lawyer traveled to New Mexico and obtained James Whitney's release on bond.
The trial of Whitney was first scheduled to be heard in Los Lunas. But this was Otero country and Whitney's lawyer asked for a change of venue. Finally, at Clayton, New Mexico, the jury brought in a verdict of "not guilty."
Now Otero's heirs sued for their claim to the Baca Grant. In l899, after several years of bickering, the Court of Private Land Claims ruled that neither the Oteros nor the Whitneys had a legal claim to the coveted Estancia Valley.
