The Rules in Plain English
Dave's Yo-Yo Talk (the Board) is provided as a service by David W. Hall (Dave). It is intended for open and useful interchanges and all participants should be made to feel welcome and comfortable. To that end, your participation is subject to the terms and conditions stated here.
Dave accepts no responsibility for the opinions and information posted on the Board by individuals not officially acting on behalf of Dave. Dave disclaims all warranties with regard to information posted on the Board, whether posted by Dave or any third party; this disclaimer includes all implied warranties of merchantability and fitness. In no event shall Dave be liable for any special, indirect or consequential damages or any damages whatsoever resulting from loss of use, data or profits, arising out of or in connection with the use or performance of any information posted on the Board.
1) Do not post any defamatory, abusive, profane, threatening, offensive or illegal materials. You must use your own good judgment and sense of basic etiquette in deciding what to post. Please remember that your messages may be seen by people of all ages and sensibilities. Do not post a message you would not want your parents or your children to read.
1a) Product 'bashing' is considered to be defamatory material. If you have a criticism or a complaint about a particular product, please be civil. From time to time, representatives from the major yo-yo companies visit the Board. In most cases, Dave has personally invited these representatives to post information about their products. Like any participant on the Board, you are to treat these visitors with the utmost respect and courtesy.
1b) 'Spoofing' or pretending to be another individual is also considered defamatory material. Do not post under an identity that is not your own. Again, please be civil.
1c) 'Flaming' or reposting of deleted material as a form of protest, or repeated attempts to post materials which violate Board policies, is obviously also considered defamatory material.
2) Do not post advertising for other online stores or web boards.
3) Do not post direct links to other online stores or web boards.
4) Do not post post information regarding potentially illegal modifications to products. Potentially illegal modifications include any modification which may infringe on existing patents. A specific example of such a modification would be the deployment of break pad technology (BPT) in a yo-yo not produced by the current patent holder of BPT, Playmaxx. Under no circumstances may this modification, or any modification which may infringe on existing patents, be discussed on the Board.
NOTE: Patent law is a complex issue, and Dave does not wish to put himself in jeopardy legally by allowing this topic to be discussed. Period. This is his board, and he makes the rules. Please abide by them.
5) Do not post any information or other material protected by copyright without the permission of the copyright owner. By posting material, the posting party warrants and represents that it owns the copyright with respect to such material or has received permission from the copyright owner. In addition, the posting party grants Dave and users of the Board the non-exclusive right and license to display, copy, publish, distribute, transmit, print and use such information or other material.
If the posting party has violated or infringed a personal or property interest (including a copyright, patent or trademark) of any individual or entity in granting a license to Dave to use the material, the posting party agrees to indemnify Dave against any and all liability for payment of claims, judgment, or settlements, for violation or infringement of any personal or property rights resulting from Dave's use of the material, and for any attorneys' fees that Dave incurs in the defense of such claim.
Dave retains the right to remove inappropriate, illegal, or potentially illegal messages. When posting a message on the Board, you have agreed to abide by Board rules. Any posting not meeting the guidelines above may be removed at any time without notice to the poster.
Dave expects you to treat any participant on the Board with the utmost respect and courtesy. You may not like their ideas. You may not like them personally. But you will not be rude in any way or your posts will be deleted.
Please do not take Board discipline upon yourself. If someone violates Board rules, the offending message will be dealt with. Under no circumstances should a violation of Board rules be viewed by any other participant as an invitation to further violate Board rules by posting any defamatory, abusive, profane, threatening, offensive or illegal materials.
Dave retains the right to take further action, if any individual repeatedly violates these rules. Such actions may include the banning the individual from the Board, and contacting the individual's service provider.
AND, HERE ARE THE RULES IN PLAIN ENGLISH
1) No foul or offensive language. No rude or obnoxious behavior. No product bashing. No spoofing. No flaming.
2) No advertising for other online stores or web boards.
3) No direct links to other online stores or web boards.
4) No talk of potentially illegal modifications to products (i.e. modifications that may infringe upon existing patents).
5) No plagiarism.
Important final note regarding the rules posted above:
Abuse, no matter the victim, is rude and obnoxious behavior, and therefore against board policy. Such posts will be deleted, regardless of the author.
What topics should we discuss here at Dave's Yo-Yo Talk? If if has anything to do with yo-yos, and it's not illegal or potentially illegal, it's a valid topic. Post your yo-yo information, questions, and stories here. Everyone, join the discussion and share your information.
The emphasis here at Dave's Wonderful World of Yo-Yos always has been Yo-Yo Collecting and Yo-Yo history. I would like the web board to reflect that as well. Yo-Yo Collectors, this board is yours. But everyone is welcome, collectors and players, experts and beginners, manufacturers and consumers, and anyone with a love for yo-yos.
This is the forum where we can discuss collectible items, playing yo-yos, and share stories about the history of Yo. The exchange of ideas and information about yo-yos... That's what this board is all about.
